Employers need to comply with the Fair Credit Reporting Act (FCRA) when using consumer reports which include but are not limited to credit reports, criminal records, SSN traces, and driving records. Your responsibilities as an employer when using consumer reports for employment purposes are found in sections 604, 606, and 615 of the FCRA. As an employer, you may use consumer reports when you hire new employees (pre-employment screening) and when you evaluate employees for promotion, reassignment, and retention (employee screening).
